DIS inspections exceeds the NM AG requirements and comes with 40 photos and 3 paint meter readings per panel to assure your customers that you have provided them with the most accurate inspection in the market today.

 

The 6% Rule and what it means to you.

In 2013, the New Mexico Attorney General's office implemented NMAC 12.2.14. With Section 57-12-6 NMSA 1978 requiring  dealers to provide their customers an affidavit that reads:

" .... a seller of a motor vehicle shall furnish at the time of sale of a motor
vehicle an affidavit that :

• "states to the best of the seller's knowledge whether there has been an alteration or chassis repair due to wreck damage"

• " no affidavit shall be required if the flat rate manual cost of the alteration or chassis
repair is less than six percent of the sales price of the vehicle."

• "Any person who violates this section is guilty of a misdemeanor."

 

 

 What dealers must do to stay in compliant with state laws:

Implementation of 6% Disclosure Law

1. A seller of a motor vehicle shall furnish at the time of sale of a motor vehicle an

    Affidavit that states to the best of the seller's knowledge...

2. When a seller in good faith:

A. Conducts a motor vehicle inspection in compliance with 12.2.14.10 NMAC;
B. Completes an Inspection Report pursuant to 12.2.14.11 NMAC
C. Provides the Inspection Report and Affidavit to the buyer; and
D. Maintains the Inspection Report and Affidavit in seller's records for four years

 

Failure to comply with this rule could and has resulted in

dealers paying triple damages, court and lawyers costs!
